Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ACE-Flex website and program (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
ACE-Flex provides a structured online program designed to help people build executive functioning skills, along with tools for accredited practitioners to enrol and support their clients. The program content is delivered through our online learning platform, and your progress is tracked within your account.
2. Not Medical Advice
ACE-Flex is an educational and skills-building program. It is not a medical device, does not provide medical or psychological diagnosis or treatment, and is not a substitute for professional healthcare. Always seek the advice of a qualified health professional with any questions you may have regarding a health condition. If you are in crisis or believe you may harm yourself or others, contact emergency services immediately.
3. Accounts
You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for all activity that occurs under your account. You may sign in using an email and password or through Google sign-in. You must be at least 13 years old to use the Service; if you are under 18, you should use the Service with the involvement of a parent, guardian, or practitioner.
One account per email address. If an email address is already registered, you should sign in with that account rather than creating a second one — we do not permit the same person to hold separate learner and practitioner accounts on the same address.
4. The Learning Platform (Moodle)
Program content is delivered through Moodle, a separate learning platform we operate at ace-flex.moodlecloud.com. When you register for ACE-Flex, we automatically create a matching learning account for you there using your name and email address, and enrol you in the modules your access level includes. You do not need to sign up separately.
Your Moodle account is part of the Service and these Terms apply to your use of it. Your activity in the modules — including progress and completion — is recorded there and may be visible to ACE-Flex administrators and, where you are enrolled through a practitioner, to that practitioner.
The learning platform is hosted on MoodleCloud and is operated by Moodle Pty Ltd, which sets its own terms for it. The first time you open a module you will be asked to read and accept Moodle's Privacy Notice, Moodle's Cookies Policy and the MoodleCloud Terms of Service. These are agreements between you and Moodle Pty Ltd, they are separate from these Terms, and ACE-Flex cannot accept them for you or waive them. It is a one-time step per account.
If your ACE-Flex access changes or ends, we may correspondingly change or remove your enrolment in the Moodle courses.
5. Practitioner Accounts
Practitioner access is available to accredited professionals who apply and are approved by ACE-Flex. Practitioners are responsible for the accuracy of their application details, for maintaining any professional registrations they claim, and for using client information available through the Service only to support those clients and in accordance with their professional obligations.
6. Subscriptions and Payment
Some parts of the Service are free; full program access requires a paid subscription or a redemption code. Payments are processed securely by Stripe. Subscriptions renew automatically until cancelled, and you can cancel at any time — access continues until the end of the current billing period. Except where required by law, payments are non-refundable.
7. Acceptable Use
You agree not to:
- Share your account or program access with others, or resell access to the Service.
- Copy, redistribute, or create derivative works from the program content without our written permission.
- Attempt to gain unauthorised access to the Service, other users' accounts, or our systems.
- Use the Service in any way that is unlawful, harmful, or interferes with its operation.
8. Intellectual Property
All program content, materials, and branding are owned by ACE-Flex or its licensors and are protected by copyright and other intellectual property laws. Your subscription grants you a personal, non-transferable licence to access the content for your own use (or, for practitioners, to support your enrolled clients). No other rights are granted.
9. Privacy
Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.
10. Termination
You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access if you breach these Terms, misuse the Service, or where required for legal or security reasons. Sections of these Terms that by their nature should survive termination (such as intellectual property and limitation of liability) will survive.
11. Disclaimers and Limitation of Liability
The Service is provided on an "as is" and "as available" basis. While we work to keep the Service reliable and accurate, we do not guarantee that it will be uninterrupted, error-free, or that the program will achieve any particular outcome for you. To the maximum extent permitted by law, ACE-Flex will not be liable for any indirect, incidental, or consequential loss arising from your use of the Service, and our total liability in connection with the Service is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these Terms excludes rights you have under applicable consumer protection law.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page, and significant changes will be communicated through the Service or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
